What sets rape apart from other sex crimes?

All sex-related crimes are major crimes that must be taken very seriously. Rape is one of the most serious sex-related crimes that a person can face. While many people have heard the term rape, many people don't realize exactly what is a considered a rape.

What is rape?

Rape occurs when there is unwanted intercourse between two people. The common law definition of rape was that a man forced himself on a women who wasn't his wife. That definition has since expanded to include the point that the person who is committing the rape can be male or female. Marriage, gender and force aren't elements that are considered for rape charges now.

How is rape different from other sex crimes?

Rape differs from other sex crimes in that penetration is required for a rape charge. It doesn't matter how slight the penetration is, the act can still be considered a rape. That is the main difference between rape and other sex-related crimes. Most sex-related crimes have the common element of lack of consent.

What are the different types of rape?

Rape, forcible rape and statutory rape are the three main forms of rape. The elements of the case determine which of these types of rape occurred. Statutory rape, for example, requires that the victim isn't of age to consent to sexual activities.
